Yesterday, May 9th 2018, the Government accepted the principle of an amendment to the Data Protection Bill tabled by Dr Sarah Wollaston MP, Chair of the Health and Social Care Committee.<\/p>\n

The amendment restricts NHS Digital to being able to share data relating to criminal investigations only for ‘serious offences’ – this does not include immigration status and offences. <\/p>\n

This data sharing of migrants\u2019 patient information has been going on for many years and was most recently formalised in a Memorandum of Understanding (MoU) between NHS Digital, the Home Office and Department of Health and Social Care.<\/p>\n

\"\"A campaign spearheaded by the National AIDS Trust (NAT) along with Doctors of the World (UK, led a campaign to end the practice since it came to light in 2014. Most recently the Health and Social Care Committee published a report strongly criticising the MoU and the immigration tracing service, demanding that it end immediately. The campaign gathered pace once it reached social media with doctors and other healthcare professionals proclaiming #PatientsNotPassports.<\/p>\n

Deborah Gold, Chief Executive of NAT, said: \u201cWe are delighted that at last this shameful sharing of confidential patient information with the Home Office is to end. Not only did it breach every bit of guidance on confidentiality within the NHS, it also deterred people from essential healthcare putting both individual and public health at risk.”<\/p>\n

Dr Chloe Orkin, Chair of the British HIV Association (BHIVA), commented: \u201cWe welcome this change by the government which means that patients will no longer be deterred from accessing vital healthcare services.  This is beneficial for both the individual and for public health. HIV patients are particularly vulnerable as without treatment their health can decline rapidly, as well as posing a potential transmission risk to others.\u201d<\/p>\n
